JURISDICTION
Tulalip Tribes, WA
The Tulalip Tribes Planning Department, under Public Works, issues building, land use and grading permits and states that the Tribes have permitting jurisdiction over lands within the Reservation's exterior boundaries regardless of ownership. Tribal permits address compliance with Tulalip Tribal law only, and applicants remain responsible for complying with other jurisdictions' laws. Snohomish County's tribal jurisdiction parcel data treats Indian trust land, pending trust land, and fee land owned by tribal members or tribal associations as outside County jurisdiction; other fee land within the Reservation, including land owned by nonmembers, is generally permitted by Snohomish County PDS, and for nonmember-owned fee land Tulalip Tribal Code 7.06.050(5)(b) requires the Tribes to make specific findings before exercising jurisdiction. Applications are submitted by email to permits@tulaliptribes-nsn.gov, by mail, or in person at Tulalip Tribes Administration, 6406 Marine Drive NW.

A building permit submittal includes the signed application, a title or lease for the property, a site plan with boundaries, structures, setbacks, roads, utilities and waterbodies, a location map covering at least 500 feet around the project, structural plans stamped by a Washington State engineer, and WSEC energy forms. Staff may also request a drainage plan, erosion control plan, topographic map, wetland delineation, cultural survey, traffic study, environmental checklist, survey, or well and septic permits. Applicants select the International Code year (2015, 2018, 2021 or 2024) on the form and check Tulalip Tribal Code 7.14.100 for the currently accepted code.
Commercial tenant improvements and change of use
The Planning Department issues Use and Occupancy permits and Sign permits, and contractors and subcontractors need a current Tulalip Business License and may be subject to Tribal Employment Rights Office (TERO) review. Applicants should contact Tax and Licensing and TERO before construction.
Land use review
Land use permits include subdivisions, rezones, variances, boundary line adjustments, conditional use permits, tribal family subdivisions, and short-term rental and event-based business permits, governed by Tulalip Tribal Code Title 7 and the Official Zoning Controls Map. A formal pre-application process was not described on the pages reviewed.
Corrections and review
Staff check applications for completeness and, within five business days, provide a permit reference number, fees and an estimated review time; multiple Tribal departments and a contracted building official then review for consistency with Tribal codes. The Planning Department states simpler applications may take up to four weeks and complex applications more than three months.
Tips from SASHKOV
- Confirm whether the parcel is trust, tribal-owned fee or nonmember fee land before applying, and check with both the Tulalip Planning Department and Snohomish County PDS for fee land.
- Use the same International Code year consistently across all plans and documents.
- Contact Tax and Licensing and TERO before construction begins; contractors need a current Tulalip Business License.
